Vladimir Djerić appointed as substitute member of the Venice Commission of the Council of Europe

We are pleased to announce that Vladimir Djeric, attorney at law from MJB, has been appointed as substitute member of the Venice Commission from Serbia. The Venice Commission (European Commission for Democracy Through Law) is the Council of Europe’s advisory body on constitutional matters, composed of “independent experts who have achieved eminence through their experience in democratic institutions or by their contribution to the enhancement of law and political science” (article 2 of the revised Statute). Members and substitute members serve in their individual capacity.

Dejan Bogdanovic elected President of the AIPPI National Group of Serbia

We are pleased to announce that Mr. Dejan Bogdanovic, a senior partner in the Law Office of Mikijelj Jankovic & Bogdanovic, was elected President of the AIPPI National Group of Serbia at its Meeting of 5 March, 2011.

Bosnia and Herzegovina: Entry into Force of a New Set of IP Laws

In Bosnia and Herzegovina, a new set of laws in the field of intellectual property came into force on January 1, 2011, namely:

• Trademark Law
• Patent Law
• Law on Industrial Designs
• Law on Protection of Indications of Geographical Origin
• Law on Protection of Topographies of Integrated Circuits

Entry into force of the new IP legislation was followed by an introduction of the new Tariff of Administrative Fees.

Montenegro: Entry into force of the new Trademark Law

On 30 November 2010, the Government of Montenegro adopted the new Trademark Law. The law was published in the Montenegrin Official Gazette on December 8, 2010 and came into force on December 16, 2010.

The important provisions of the new law are as follows:

• All Serbian trademarks registered before 28 May 2008 that have not yet been re-registered or renewed in Montenegro will have a 12 month term to be re-registered in Montenegro. This term expires on 16 December, 2011. In order for a trademark to be re-registered, it will be necessary to obtain a certificate of validity from the Serbian IP Office. Any additional requirements will be prescribed by the corresponding by-laws regulating the new law, which will be adopted within the next six months.
• The new law provides for opposition procedure for new trademark applications. After formal examination, trademark applications will be published in the Montenegrin IP Office Gazette and will be subject to opposition by third parties within a term of 90 days from the date of publication of the trademark application.
